1. General Provisions

1.1. Miledi Magic is the official website of the Miledi trademark, specializing in the production and sale of exclusive, custom bead embroidery kits, utilizing proprietary innovative techniques.

1.2. All products available on the website are either exclusive developments of our company or products sold on behalf of other brands with which we cooperate as a retailer.

1.3. By using this website, you confirm your agreement with the terms of this agreement.

 

2. Order Placement

2.1. Ordering a product on the website is a confirmation of the Buyer’s intention to purchase the selected product.

2.2. The Buyer confirms the accuracy of the provided data for delivery and payment of the product. The order is considered placed after all the Buyer’s details are confirmed.

2.3. The Buyer has the right to modify or cancel the order before it is shipped.

 

3. Kit Composition

3.1. Miledi Magic reserves the right to modify the kit composition without prior approval from the Buyer, ensuring that any changes will result in the provision of products of equivalent or higher quality.

3.2. In the event of a change in composition, the products added to the kit will be of equivalent quality and functional characteristics. All substituted components will match or exceed the quality level of the original kit composition.

 

4. Delivery

4.1. Products are delivered to the Buyer through transport companies with which Miledi Magic cooperates. The cost and delivery time are calculated depending on the chosen transport company and the Buyer’s location.

4.2. The Buyer is obligated to check the product upon receipt. If any damage occurs during transport, the Buyer must notify the Seller within 24 hours of receipt.

 

5. Payment

5.1. The product is paid for by transferring funds to the bank account, through payment systems, or upon receipt. All payment conditions are specified to the Buyer during the order process.

5.2. The Buyer confirms the accuracy of the provided data for making payments and delivering the product.

5.3. Payment for the products must be made in full prior to shipment, unless conditions allowing payment after receipt are specified.

 

6. Returns and Exchanges

6.1. The Buyer has the right to return the product within 14 days from the date of receipt, provided the product has not been used and retains its original condition.

6.2. Products that cannot be returned or exchanged:

  • Software products, including electronic versions of items (patterns, kits for embroidery, etc.).
  • Custom designs, bracelets, and other individualized or exclusive items.
  • Products that have been used or damaged after receipt.
  • Products that are part of kits and cannot be returned separately.

6.3. Products may be exchanged or returned under the following conditions:

  • If defects or poor quality of the product are detected, supported by the relevant expertise.
  • If a product is returned due to an error in order fulfillment or receiving a product that does not match the order.

 

7. Damages During Shipping

7.1. Miledi Magic is not responsible for product damage during shipping, as the product is transferred to the transport companies for delivery. All claims related to damaged products must be filed directly with the transport company.

7.2. The Buyer is obligated to inspect the product upon receipt. In case of damages or defects, the Buyer must immediately contact the transport company to resolve the issue of compensation or return.

7.3. If the product was damaged due to an error on Miledi Magic’s side (e.g., improper packaging), Miledi Magic is ready to resolve the situation by returning or replacing the product.

 

8. Copyright

8.1. All designs used on the Miledi Magic website (including but not limited to proprietary patterns, software swatches, bracelets, embroidery kits) are intellectual property of the company and are protected by copyright under the applicable laws of Ukraine.

8.2. Copying, reproducing, plagiarism, or any form of modification of our designs without prior written consent is a violation of copyright and may lead to legal action in accordance with the laws of Ukraine.

8.3. Any attempts to unauthorized use of our designs, such as publishing, reproducing them on third-party platforms, or using them commercially without permission, are illegal and may be subject to legal action, including fines and compensation for damages.

8.4. All rights to created products (including embroidery patterns, original images, programs, and other design elements) belong exclusively to Miledi Magic. The Buyer agrees not to use these materials for resale, distribution, or creating new products based on them without prior permission from the copyright owner.

8.5. In case of copyright infringement, the company reserves the right to contact the competent authorities to protect its rights and interests in court.

 

9. Website Use Rules

9.1. Users of the website are required to comply with the laws of Ukraine, not violate copyright laws, and not perform actions that could harm the normal operation of the website.

9.2. Using materials from the website without permission is prohibited. In case of violation of this clause, we reserve the right to claim compensation for damages and take other legal actions.

 

10. Use of Personal Data

10.1. Miledi Magic is committed to protecting the confidentiality of personal data of its customers in accordance with the laws of Ukraine, specifically the "Personal Data Protection" Law of Ukraine.

10.2. When placing an order on the Miledi Magic website, the Buyer provides their personal data, such as name, contact information, delivery address, and other details necessary for order processing.

10.3. Personal data of the Buyer are collected and processed by Miledi Magic solely for the purpose of fulfilling the order (processing the order, delivering the product, communicating with the Buyer).

10.4. Miledi Magic does not share personal data with third parties without the Buyer’s prior consent, except in cases provided by Ukrainian law (for example, to facilitate delivery or upon request by law enforcement agencies).

 

11. Other Terms

11.1. Miledi Magic reserves the right to modify these terms without prior approval from the Buyer. Updated terms are published on the website and become effective immediately upon publication.

11.2. In the event of a dispute, the parties agree to resolve the issue through negotiations. If no compromise is reached, the dispute will be submitted to the court in accordance with the laws of Ukraine.
